E-SIGN Consent to Electronic Records

This notice explains that you consent to receive agreements, disclosures, notices, and other records from TradeSpark in electronic form, as permitted by the federal Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001, and comparable state laws.

1. What you consent to

By creating a TradeSpark account or using the Service, you consent to receive in electronic form all agreements, disclosures, notices, statements, receipts, records, and other communications from TradeSpark, our Pros (with respect to platform transactions), and our service providers (together, "Records"). Electronic Records may be delivered by email to the address on your account, by a message or document inside the webapp, through SMS where you have separately consented, or by posting on our website.

You are responsible for providing a current email address and keeping it up to date. If email delivery to your address fails, we may suspend electronic delivery until you update it. Update your account settings in the webapp or email hello@tradespark.ai.

5. Paper copies

You can request a paper copy of any Record by emailing hello@tradespark.ai within a reasonable time after delivery. We may charge a reasonable fee to cover copying and mailing, unless applicable law requires us to provide the copy free of charge.

6. Withdrawing your consent

You may withdraw your consent to receive electronic Records by emailing hello@tradespark.ai with subject "Withdraw E-SIGN consent". Withdrawal is effective only after we have had a reasonable time to process it. Because electronic delivery is core to how the Service works, withdrawing your consent may mean we cannot continue to provide the Service to you and your account may be terminated.

7. Validity of electronic signatures and records

You agree that electronic signatures, clicks, taps, and other indications of agreement (for example, clicking "I agree" or creating an account) have the same legal effect as a handwritten signature, and that electronic Records have the same legal effect as paper Records, to the full extent permitted by law.
