For Pros. If you apply to join TradeSpark as a trade professional, we may ask a consumer reporting agency to prepare a "consumer report" or "investigative consumer report" about you for the purpose of evaluating your eligibility for the Pro network. This page includes the disclosures and rights required under the federal Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq., and comparable state laws. Read it carefully before consenting.
1. What we may request
With your authorization, we (or a consumer reporting agency acting on our behalf) may obtain and review:
- Criminal history records (federal, state, county, and where permitted, sex offender registry checks).
- Verification of your identity, Social Security Number, and address history.
- Verification of professional licenses, certifications, and insurance.
- Business entity and lien checks relevant to construction licensing and consumer protection.
- Driving records where relevant to the services you intend to offer.
- In some cases, an investigative consumer report, which may include interviews about your character, general reputation, personal characteristics, or mode of living. You may request additional information about the nature and scope of any investigative consumer report by writing to us at the address below.
We obtain consumer reports solely for purposes of evaluating your eligibility to join and remain in the Pro network, in accordance with the FCRA and applicable state laws.
2. Consumer reporting agencies
We may work with one or more consumer reporting agencies ("CRAs"). The specific agencies we engage are disclosed during the background-check process. CRAs that prepare consumer reports are required to follow reasonable procedures to assure maximum possible accuracy of the information they report.
3. Your written authorization
Before we request a consumer report, we will ask you to sign a standalone written authorization acknowledging that you have received the standalone Disclosure form required by 15 U.S.C. § 1681b(b)(2). Your authorization is voluntary, but we cannot proceed with your application if you decline.
4. Your rights under the FCRA
You have the following rights, among others:
- To be told if information in a consumer report has been used against you.
- To know what is in your file from a CRA.
- To dispute incomplete or inaccurate information with the CRA.
- To have a CRA correct or delete inaccurate, incomplete, or unverifiable information, generally within 30 days.
- To be notified if public-record information is reported for employment purposes.
- To seek damages from violators.
Many states and some cities provide additional rights. A full summary of your rights under the FCRA is available from the Consumer Financial Protection Bureau at consumerfinance.gov, and we will provide a copy with our background-check disclosure.
5. Pre-adverse action and adverse action
If, based in whole or in part on information in a consumer report, we are considering denying, suspending, or removing your Pro status, we will:
- Provide you with a pre-adverse action notice, a copy of the consumer report, and a summary of your FCRA rights.
- Give you a reasonable period (typically at least 5 business days) to review the report and dispute any inaccuracies with the CRA before we make a final decision.
- If we proceed with an adverse action, provide you with an adverse action notice that includes the CRA's name and contact information, a statement that the CRA did not make the decision, and notice of your right to obtain a free copy of the report from the CRA and to dispute the accuracy or completeness of the information.
6. State-specific rights
Certain states (including California, Minnesota, New York, Oklahoma, and Washington) provide additional rights, including the right to request a copy of any report we obtain or to check a box during the application so the CRA will send you a copy directly. We will provide a state-specific supplement during the background-check process to the extent your state requires it.
